SiBio requests suspension of Abbott’s preliminary injunction in EU member state markets in UPC order

( August 19, 2024, 15:00 GMT | Official Statement) -- MLex Summary: SiBio, a medical technology startup, has requested to suspend the impact of provisional measures imposed by Abbott Diabetes Care Inc., a prominent glucose-monitoring technology provider, in an order from the Court of Appeal of the Unified Patent Court. The suspension request came as the court considers its appeal. Abbott had applied for a preliminary injunction in March to provisionally halt allegedly infringing activities in EU member states where its patents are enforced on technologies used for on-body sensor devices to manage diabetes. The ruling clarifies that businesses will not be able to protect their patent rights in Ireland through the UPC, until that country ratifies its participation in the system, which was launched last year.The Unified Patent Court's order is attached....
