Judge denies Apple move to block determination of whether Qualcomm patent offers were Frand

( March 20, 2019, 23:10 GMT | Official Statement) -- MLex Summary: A federal judge in San Diego said the court has jurisdiction to decide whether Qualcomm's offers to license its standard-essential patents to Apple were "fair, reasonable and non-descriminatory," or Frand. US District Judge Gonzalo Curiel denied Apple's motion that the court didn't have jurisdiction to make that decision. "The Court concludes that it has subject-matter jurisdiction over Qualcomm’s declaratory judgment claim," Curiel said, referring to Qualcomm's allegation "that Apple has engaged in conduct that constitutes unreasonable holdout behavior, and demonstrate[s] that it is an unwilling licensee."See attached order....
