( August 30, 2013, 22:31 GMT | Official Statement) -- MLex Summary: End-payor plaintiffs have moved for partial summary judgment on defendants' 'pass-on affirmative defenses' that plaintiffs' claims are barred to the extent that they seek damages for any alleged overcharge plaintiffs passed on to other entities. EPPs argue they are at the end of the chain of distribution, do not sell Skelaxin or metaxalone, and thus cannot 'pass-on' any overcharge to others.See document below....
