Dilly's Wellnesshotel could lose Austrian battle over energy-tax reimbursements

( February 14, 2019, 10:51 GMT | Official Statement) -- MLex Summary: Dilly's Wellnesshotel could lose its legal challenge of decisions made by Austrian tax authorities to reject the hotel operator's request for reimbursements of taxes paid on energy for 2011 and the period between February 2013 and January 2014. Today, a legal adviser to the EU's highest court recommended that Austrian changes to the group of beneficiaries didn't need to be notified to the European Commission, therefore they were legal. In that case, Dilly's Wellnesshotel wouldn't be entitled to any money back because it didn't form part of the group of beneficiaries. Today's opinion is non-binding on the court. The AG Opinion is attached. The case reference is C-585/17. ...
