Austrian court confirms national authorities' cooperation in dawn raids

( June 13, 2017, 08:19 GMT | Official Statement) -- MLex Summary: The Austrian Supreme Court has decided that the national antitrust watchdog, BWB, was right to carry out inspections in the country at the request of Germany's Bundeskartellamt. Judges said the BWB's assistance to the Bundeskartellamt was governed by EU competition rules. But the legality of the search warrant and the conduct of the inspections had to be assessed under Austrian law. Therefore, the court dismissed arguments that the Bundeskartellamt's request was subject to a prior assessment under German law by either a German judge or the Austrian cartel court, which granted the warrant. The court also ruled that a German leniency application from the company under investigation didn't prevent the BWB from conducting its dawn raid.German statement follows....
