Zoosk says named plaintiff in US data breach litigation must be dismissed with prejudice

( March 24, 2022, 19:02 GMT | Official Statement) -- MLex Summary: Zoosk told a federal judge in San Francisco that named plaintiff Amber Collins must be dismissed with prejudice from litigation against the online dating platform following her convictions for methamphetamines. "As evidenced by the timeline set forth above, Plaintiff Collins must have been in contact with her counsel while incarcerated in order for her counsel have been able to prepare and to have been authorized to serve her December 27 Supplemental Responses, so Plaintiff Collins cannot credibly point to her incarceration as the cause for her failure to prosecute her claims," Zoosk said. "And even if she could, clearly, Plaintiff’s incarceration did not result from circumstances 'out of her control': It is due to her affirmative choice to possess and attempt to distribute methamphetamines."See attached document....
