TechFreedom says FTC ruling against LabMD would be 'bad public policy'

( February 5, 2016, 23:44 GMT | Official Statement) -- MLex Summary: TechFreedom has asked to file an amicus brief in the litigation between the US Federal Trade Commission and LabMD, saying that the FTC's claim that LabMD is liable for a data breach involving the exposure of its customers' personal information would "lead to improvident and dangerously ineffective and arbitrary regulation that will harm consumers." An administrative law judge dismissed the complaint, finding that the FTC didn't demonstrate harm, but the full commission must review that decision. TechFreedom said the FTC "ruling against LabMD in this case would be to ignore plain statutory language and instead convert Congress’s three-part test for unfairness into one of strict liability — triggered not even by a breach, but by whatever the Commission decides is too great a risk of a breach."See document below....
