Judge splits liability portion of Provigil case into two phases

( June 8, 2017, 21:09 GMT | Official Statement) -- MLex Summary: US District Judge Mitchell Goldberg has split the liability portion of a trial in a case accusing Cephalon and four generic drug companies of illegally delaying generic versions of the sleep disorder drug Provigil. Goldberg decided to separate the trial into violation and causation, and to only inform the jury during the causation portion that the relevant patent was invalidated, saying that the ruling is irrelevant to the rule of reason analysis but relevant to an antitrust causation showing. See document below. ...
