On 14 March 2011, the Commission received a notification of a proposed concentration pursuant to Article 4 of Council Regulation (EC) No 139/2004 ( 1 ) by which Caterpillar Inc. (‘Caterpillar’, USA) acquires within the meaning of Article 3(1)(b) of the Merger Regulation indirect sole control of MWM Holding GmbH (‘MWM’, Germany) by way of a purchase of shares. The concentration has been referred to the Commission by the German Competition Authority pursuant to Article 22(3) of the Merger Regulation. The referral was subsequently joined by Austria and Slovakia....
