EU electricity market rules don’t forbid penalties for early contract termination, top EU court says

In a judgment delivered this morning, the EU’s top court said the amount of the penalty can even correspond to the full price of the electricity the customer agreed to purchase, given certain conditions are met. Today’s ruling follows a referral made by the Warsaw district court, asking for guidance about avoiding paying penalties for ending a fixed-term energy supply contract ahead of time when switching suppliers.The judgment is attached.
