Capital One must turn over forensic data breach report, judge rules

Trenga has adopted a magistrate judge’s recommendation that Capital One must allow plaintiffs suing over a 2019 data breach to review a cybersecurity firm’s forensic report related to the incident. He said that the report is not protected work product because Capital One had a business critical need for information related to a breach, it contracted Mandiant to provide that information, and after the breach at issue, Capital One arranged to receive through a law firm the information it already had contracted to receive directly from Mandiant.See document below. ...
