CTS Eventim loses bid to appeal contract-terms ruling at German Supreme Court

( June 25, 2020, 12:44 GMT | Official Statement) -- MLex Summary: German ticketing-system operator CTS Eventim can't challenge a lower court decision that confirmed a ban on its abusive exclusive terms in contracts with organizers of live events and advance booking offices. The Supreme Court has dismissed the company's appeal of the lower court's refusal to allow an appeal. The lower court had been right to find that the "as-efficient-competitor-test" as stipulated in an EU court ruling on Intel can't be used to fend off competition concerns, the ruling reads, as the test only relates to cases where rebates are granted but not to exclusivity agreements.
