Retired judges urge Supreme Court to rule that district judges can decide when MDL cases are appealable

( October 22, 2014, 22:46 GMT | Official Statement) -- MLex Summary: A group of retired federal judges urged the US Supreme Court not to develop a blanket rule and instead leave it up to lower courts to decide whether plaintiffs whose claims are dismissed early on in complex litigation can immediately appeal or must wait until all related cases are finished. The former judges, three of whom previously served on the US Judicial Panel on Multidistrict Litigation, include: Louis Bechtle of the Eastern District of Pennsylvania; W. Royal Furgeson Jr. of the Western District of Texas; Barbara S. Jones and Michael B. Mukasey of the Southern District of New York; A. Howard Matz of the Central District of California; Stephen M.
