Judge partially dismisses Fair Credit Reporting Act claim in data breach suit against Experian

( December 29, 2016, 23:32 GMT | Official Statement) -- MLex Summary: US District Judge  Andrew Guilford has granted in part and denied in part Experian's motion to dismiss a class action suit accusing the credit reporting agency of violating the Fair Credit Reporting Act related to a 2015 data breach that exposed the personally identifiable information of approximately 15 million consumers. "Since Plaintiff cannot allege that there was a 'furnishing' of credit reports under the FCRA, granting leave to amend would be futile," the judge said, granting Experian's motion to dismiss counts under Section 1681e of the FCRA.See document below. ...
