Vizio's settlement with FTC does not moot damages in privacy litigation, plaintiffs say

( May 4, 2017, 22:58 GMT | Official Statement) -- MLex Summary: Plaintiffs pursuing class-action claims that smart television maker Vizio violated the Video Privacy Protection Act are opposing the company's motion to dismiss that litigation in the wake of its $2.2 million settlement with the US Federal Trade Commission over allegations of the same conduct. "Vizio's recent tactical maneuver of entering into a consent decree with the Federal Trade Commission (FTC) does not forever moot Plaintiffs' entitlement to any injunctive relief," they told US District Judge Josephine Staton, saying Vizio can't show that the "effects of any past violation have been completely and irrevocably eradicated."See document below....
