ECJ: Judgment in Case C-6/08 P US Steel Košice vs Commission

( June 19, 2008, 15:26 GMT | Official Statement) -- ****************************************MLex-e3 Summary: The European Court of Justice has dismissed an appeal by US Steel Košice against a European Commission decision to amend Slovakia's National Allocation Plan (NAP) for EU emissions trading. The court ruled that a reduction in allowances given to the company was decided by the Slovak authorities and that they had the discretion over the specific allocation to the company's installations. Moreover the court found that "quantities mentioned in the NAP that a Member State plans to allocate to certain installations are for guidance only." The court also found that the contested decision, in any case, of direct concern to the appellant within the meaning of the EC treaty....
