Servier challenge over lower court ruling on blood-pressure drug UK suit heard by Supreme Court

( June 9, 2020, 22:22 GMT | Official Statement) -- MLex Summary: Servier's challenge over a lower appeal-court ruling last year that dismissed its bid to limit the scope of an upcoming UK damages lawsuit by health authorities over its blood-pressure drug has been heard by the Supreme Court. The French drugmaker has argued that findings of fact in an judgment by the EU General Court should have a binding effect on the UK proceedings. The dispute stems from 2014, when Servier and five makers of generic drugs were fined 428 million euros by the European Commission for restricting the supply of generic versions of perindopril, marketed under the brand name Coversyl in the UK. The UK government alleges that Servier’s pay-for-delay deals meant it abused its dominant market position from 2001 to 2007 to stifle competition.
