U.S. District Judge Robert Scola also ordered Florida West International Airways to hire a compliance officer to create an internal compliance program.
Washington – A Florida federal judge sentenced a Miami air cargo company to pay a $1 million criminal fine for price-fixing and five years of probation.
At a hearing in Miami last week, U.S. District Judge Robert Scola also ordered Florida West International Airways to hire a compliance officer to create an internal compliance program, according to the final judgment entered Monday (see here).
Florida West pleaded no-contest to fixing prices on air cargo shipments from Colombia to Miami (see here).
Monday’s ruling is in line with a U.S. Department of Justice request for a $1 million fine. The airline had asked for a lower fine, citing an inability to pay.
Given the company’s financial situation, Florida West will be allowed to pay its fine in installments over the five-year probation period, according to Scola’s judgment.
As part of its probation, the company must maintain and produce its financial records to its probation officer and is prohibited from seeking bankruptcy protection....
