Court of Justice: Judgment in C-521/11 Amazon.com International Sales et al. [private copying compensation]

( July 11, 2013, 08:51 GMT | Official Statement) -- MLex Summary: The European Court of Justice ruled that Austria's Supreme Court must determine whether practical difficulties for compensating rightsholders for private copying exist that would justify a general levy collecting system on blank CDs and DVDs. Such a system may be allowed under EU law, the court said. The case stems from a dispute between an Austrian royalty collecting society and Amazon.com, which contested a so-called “blank-cassette” levy. The EU’s highest court also said there may be a presumption that individuals use recording media for private copying.Read the full judgment below....
