Objectors to Google's cy pres-only Street View settlement ask US appeals court to rehear

The Court of Appeals for the Ninth Circuit affirmed approval of the agreement in December. Plaintiffs argue that the panel decision resurrects a conflict the Ninth Circuit previously resolved and generates a new conflict with the Third Circuit. “No other federal appellate circuit to consider cy pres questions has endorsed a settlement that substitutes cy pres relief wholesale for class recovery, leaving class members empty handed in the process,” they said....
