German Court: OLG Duesseldorf – Higher Regional Court in Duesseldorf dismisses Rolex’s action for injunction against eBay in Community trademark dispute

( February 27, 2009, 11:28 GMT | Official Statement) -- ****************************************MLex Summary: The Higher Regional Court (OLG) in Duesseldorf has dismissed an action for an injunction brought by Rolex against Ebay to prevent eBay from 'allowing' commercial sellers’ on eBay from committing future Community trademark infringements by providing to sellers a platform to offer (amongst other things) counterfeit watches. The court has now ruled for the second time on the case since the court’s first judgment dismissing Rolex's action was successfully appealed on points of law to Germany's Federal Supreme Court and subsequently referred back to Duesseldorf for further consideration....
