Australian court rules Chrisco’s lay-by agreements breached consumer laws

( November 11, 2015, 07:54 GMT | Official Statement) -- MLex Summary: The Australian Federal Court has ruled that Chrisco Hampers Australia’s HeadStart Plan, which allowed Chrisco to continue to deduct payments from a customer’s direct debit account for future orders after the consumer had fully paid for their original lay-by order, breached consumer laws. The Australian Competition and Consumer Commission had alleged that Chrisco’s 2014 lay-by contracts automatically enrolled customers in the HeadStart Plan, unless the customer actively ‘opted out’ of the program. The Court also found that Chrisco made false or misleading representations to consumers that they could not cancel their lay-by agreement after making their final payment, again in breach of consumer laws.The regulator's full statement follows:...
