StarKist, Dongwon say US judge's conflicts require vacation of class cert order in antitrust case

( December 1, 2021, 02:33 GMT | Official Statement) -- MLex Summary: StarKist and Dongwon Industries say a California judge's decision to certify classes in a seafood products price fixing lawsuit against them should be vacated, based on what they say is a "substantial risk to the perception of judicial integrity" created by financial conflicts of interest. In a filing at the US Court of Appeals for the Ninth Circuit, the two companies — which are already asking the court to uphold its decision to overturn class certification on separate grounds — said Southern District of California Judge Janis Sammartino or her family members may have had undisclosed financial interests in multiple plaintiffs in the case, beyond earlier confirmations that a family member owned stock in plaintiff class members Sysco and Target. This, they say, is separate grounds for vacating class certification.  Court document attached....
