Eighth Circuit affirms summary judgment against federal antitrust claims in pre-filled propane tank case

( June 22, 2018, 16:29 GMT | Official Statement) -- MLex Summary: The US Court of Appeals for the Eighth Circuit has affirmed a summary judgment against federal antitrust claims against Ferrellgas and AmeriGas involving pre-filled propane tank marketing and sales practices. The panel determined that plaintiffs failed to show that the companies are continuing to overcharge for propane tanks. They also said that plaintiffs can’t seek disgorgement because it would violate the Supreme Court’s prohibition against indirect purchasers suing manufacturers to recover any ill-gotten gains they obtained by violating antitrust laws. The panel remanded the case to determine whether the state law claims may go forward in the district court.See document below....
