CareFirst asks judge to dismiss data breach suit

( June 13, 2018, 20:46 GMT | Official Statement) -- MLex Summary: Health insurer CareFirst has asked US District Judge Christopher Cooper to dismiss a lawsuit filed by policyholders after a 2014 data breach. CareFirst says that the plaintiffs' complaint fails to state a claim, arguing that their alleged damages remain entirely speculative, that several of their claims are barred by their contractual relationship with the company, and that they are attempting to assert a private right of action under the Health Insurance Portability and Accountability Act where none exists. CareFirst also argues that it is exempt from private civil liability under Maryland and Virginia law, and that it doesn't owe a duty of confidentiality to the plaintiffs.See document below....
