Court of Justice Statement: Advocate General’s Opinion in Case C 439/09 Pierre Fabre Dermo-Cosmétique

( March 3, 2011, 09:11 GMT | Official Statement) -- MLex Summary: Advocate General Jan Mazák has recommended that cosmetic company Pierre-Fabre’s absolute refusal to allow its French distributors to sell its products on the Internet appears to be disproportionate. Such a ban may not benefit from a block exemption allowed for certain models of distribution agreement, he says, but it may benefit from an individual exemption from antitrust law.
