Philippine conglomerate San Miguel wins US Magnolia trademark case

( September 4, 2015, 03:36 GMT | Official Statement) -- MLex Summary: The US Court of Appeals has denied an appeal by Ramar International Corp. on a 2013 District Court Judgment in favor of Philippine conglomerate San Miguel Corporation and its subsidiaries regarding the use of the “Magnolia” brand for its butter, margarine and cheese products sold in the US. The court said Ramar failed to establish that San Miguel’s use of the brand caused any irreparable injury to Ramar’s own line of Philippine-Style ice cream marketed under the same brand name. The court also recognized that San Miguel had been using the “Magnolia” brand in the Philippines long before Ramar adopted the trademark, and thereby also lifted an injunction that prevented San Miguel from introducing new Magnolia food products into the US The company's statement is attached....
