Dolby Laboratories hit with fine in South Korea for abuse of superior bargaining position

( August 12, 2021, 03:00 GMT | Official Statement) -- MLex Summary: US audio-tech giant Dolby Laboratories and its subsidiaries were hit by South Korea's antitrust regulator with a fine of 270 million won (about $233,000) and a corrective order today for abuse of superior bargaining position. The company was found to have pressured a local set-top box manufacturer to agree on audit results favorable to them by suspending without justifiable reasons the use of Dolby-patented standard technology that is essential to manufacture products. According to the Korea Fair Trade Commission, Dolby, which had a dispute with Kaon Media over unpaid royalties, refused to allow the use of its technology for several months in 2018, causing a halt in the manufacture of new set-top boxes. The commission said in a statement Dolby restricted the right to use patented technology, which was already guaranteed to Kaon Media under the licensing agreement, breaching both the competition law and the fair, reasonable, and non-discriminatory, or Frand, obligations of a standard-essential patent holder. The KFTC statement, in Korean, is attached. ...
