US DOJ wades into REX's antitrust suit against National Association of Realtors, Zillow

By Michael Acton ( August 10, 2021, 18:39 GMT | Insight) -- The US Department of Justice has filed a statement of interest in a federal lawsuit filed by real estate agency REX against the National Association of Realtors and Zillow, with the government arguing that the NAR is wrongly implying that the DOJ already took a look at the disputed rule in the case and found it to be legal. In its filing in the Western District of Washington, the DOJ — which recently pulled out of a settlement with the NAR over other elements of its rules — said a 2008 consent decree can't be used by the NAR to argue that its search-listings rule is compliant with antitrust law.
