EU court case on public tender ban for cartel member to see Council intervention
( October 9, 2026, 15:14 GMT | Official Statement) -- MLex Summary: The Council of the EU, the institution that represents member states, is planning to present observations in an EU court case regarding whether a public authority can exclude from a tender an undertaking which has been found guilty of participating in a cartel, but appealed this decision. According to an internal document obtained by MLex, the proceedings could put into question the validity of the public procurement directive, as well as the provisions of the Charter of Fundamental Rights of the European Union relating to the presumption of innocence and the right to a fair trial.Document is attached.
