National Beef Packing looks to overturn certification in US cattle price case

The company asked the court to reverse class certification. National said the plaintiffs' theory relies on episodic conduct with episodic impact — not "sustained conduct with sustained impact, the more typical grist for a class case." Additionally, the evidence offered does not actually concern the class of fed cattle producers, only feedlots, which "reveals thousands upon thousands of potentially unimpacted class members."See attached file....
