Energizer battery buyers lose US class certification bids for now
( September 28, 2026, 23:53 GMT | Official Statement) -- MLex Summary: A California federal judge denied motions for class certification in three lawsuits where consumers of Energizer batteries sued Energizer and Walmart for allegedly conspiring to keep the prices of Energizer batteries high and eliminate price competition, particularly from online retailers. Plaintiffs in the proposed Portable Power class sought to certify a class of wholesale purchasers who bought batteries directly from Energizer. Plaintiffs in the proposed Schuman class sought to certify a class of consumers who bought Energizer batteries directly from brick-and-mortar Walmart stores. And plaintiffs in the proposed Copeland class sought to certify a class of consumers who bought affected batteries indirectly. In his order, US District Judge P. Casey Pitts denied the motions "without prejudice to a possible future motion supported by different evidence."See attached document....
