Google, Apple, Samsung win dismissal of VoIP-Pal's US antitrust claims

District Judge Randolph D. Moss dismissed the claims based on claim-splitting, finding that VoIP-Pal filed an earlier action in which it asserts essentially the same claims against the same defendants. “VoIP-Pal asks the court to adjudicate its antirust and RICO claims against the platform defendants based on their alleged agreement with the carrier defendants and alleged ‘locking’ of their operating systems to prevent competitors from entering the market, and there is no reason — and certainly no reason that VoIP-Pal has identified — why it could not have brought its claims against the carrier defendants in a single action,” Moss said.
