Aetna files reply for dismissal of healthcare providers' US antitrust claims

( September 8, 2026, 21:16 GMT | Official Statement) -- MLex Summary: Aetna has filed a reply in support of its motion to dismiss a putative nationwide class of healthcare providers' US amended antitrust claims over out-of-network payments, saying that the complaint no longer alleges Aetna agreed to or did use Zelis's repricing tools, which is the parallel conduct that underlies plaintiffs' conspiracy claims. The logical result of the plaintiffs' amendment is the dismissal of their claims against Aetna, but plaintiffs attempt to walk it back by claiming the amendment was not substantive and rely on assertions that are absent from their complaint, Aetna said in its filing in the District of Massachusetts. See attached file....
