The US Court of Appeals for the Ninth Circuit has "agreed that Apple’s 27% commission had a 'prohibitive effect,' that 'no rational developer would offer' linked-out payments, that Apple 'should not be able to charge any commission for linked-out purchases until such time as the district court has approved an appropriate fee,' and that any fee going forward must be limited to Apple's 'necessary costs' — well below 27%," the app developers said. The Ninth Circuit did not decline to hold all of Apple's commissions violated the injunction as Apple claims. Instead, it held that Apple collected billions in commissions under a scheme that made linked-out in-app purchases nonviable, and that the company may not charge any commission until the court approves a fee reflecting Apple's necessary costs, the plaintiffs said.See attached document....
