Nuclear power plant operators win dismissal of US antitrust claims over wages

( August 5, 2026, 16:58 GMT | Official Statement) -- MLex Summary: Constellation Energy, Ameren, American Electric Power and other operators of nuclear power plants were granted a motion to dismiss US antitrust claims accusing them of conspiring to fix and suppress the wages of employees. US District Judge Adam B. Abelson concluded that plaintiffs failed to allege "facts that constitute direct evidence of an agreement to fix or suppress wages. And their allegations fall short of stating a claim based on circumstantial evidence of such an agreement because they do not establish parallel conduct, plus factors, or (insofar as permissible as an alternative circumstantial evidence theory) other circumstantial evidence of a wage-fixing agreement." Abelson dismissed all claims without prejudice except the information-exchange claims against Tennessee Valley Authority. See attached file....
