Illumina files reply backing dismissal of US antitrust claims over DNA sequencers

It said the plaintiff “argues that a federal antitrust complaint need not plausibly allege the elements of its claims so long as it generally alleges harm to competition,” but “the Ninth Circuit has recently reaffirmed that where alleged anticompetitive conduct falls within well-defined categories, courts evaluate it using the applicable framework for each category, and a plaintiff cannot transform deficient claims into a new form of antitrust liability.”See attached file. ...
