Paul Oetken granted a motion to dismiss the case, saying HDD’s concerted efforts to rescue its own contract with NECEC undermine the assertion that those negotiations were meant to serve as “cover” for Campos’s subsequent bid — particularly since Campos’s $20 million bid was $8 million more than what HDD had initially offered to complete the project.
