In Epic Games-Apple case, US Ninth Circuit reverses order staying mandate

( April 28, 2026, 23:21 GMT | Official Statement) -- MLex Summary: A US appeals court reversed its order that had granted Apple’s motion to stay a mandate in the company's antitrust fight with Epic Games over its App Store restrictions. Apple had previously argued that multiple substantial questions warranted a stay of the mandate, such as about the requirements for imposing a civil contempt sanction. A three-judge panel for the US Court of Appeals for the Ninth Circuit said it was "persuaded that Apple has failed to show good cause to sustain our prior stay order." It also said Apple has not raised a substantial question for review that raises a "reasonable probability" that four US Supreme Court justices will vote in favor of reviewing the decision where the Ninth Circuit affirmed the district court's ruling holding Apple in civil contempt for charging a 27 percent commission on linked-out purchases.See attached order....
