"Although Apple had already been dismissed with prejudice from this case, on the very first day that discovery opened, Plaintiffs noticed depositions for five of Apple’s senior executives," Apple said in its brief in the Northern District of California. Since then, plaintiffs served additional sets of subpoenas and have admitted the attempts were made to fish for evidence to reinstate Apple as a defendant in the litigation, Apple said. "The Court should grant Apple’s motion for a protective order and sanctions to put an end to Plaintiffs’ pattern of discovery abuse against a non-party and to compensate Apple for the substantial burden Plaintiffs’ improper discovery tactics have imposed," the company said.See attached file....
