BEH antitrust court victory should be quashed, says EU opinion for top judges

( April 23, 2026, 09:02 GMT | Official Statement) -- MLex Summary: Bulgarian Energy Holding's appeal against a €77 million fine should be re-heard, according to an advisor to the EU's top court who faulted a lower-court ruling that annulled the sanction. Advocate General Laila Medina said, in a non-binding opinion for the top court, that lower-court judges had misapplied the test for whether another company was a potential competitor, among other alleged errors. The European Commission sanctioned BEH in 2018 for blocking rivals’ access to key gas infrastructure in Bulgaria. The opinion is attached. Case reference is C-14/24. ...
