Nissan’s ‘out of time’ argument against Spanish damages claim rejected by EU judges

The ruling stems from a claim by carmaker Nissan that a damage claim filed in 2023 in Spain was time-barred because it followed-on from a decision published eight years earlier by the competition authority. The decision was confirmed in 2021 by the country's Supreme Court.EU cartel law precludes a national law that says that the countdown for a victim to bring a damages action starts before the decision by the competition authority is final, EU judges said today....
