‘Stop the clock’ for cartel claims begins once decision is final, top EU court confirms

( September 4, 2025, 11:21 GMT | Official Statement) -- MLex Summary: The EU's top court today ruled that EU cartel rules preclude national legislation, according to which a complainant can be considered to have all the necessary information to file a damages claim before the related decision by the competition authority is confirmed in court. The case refers to an action brought in 2023 in Spain against Nissan. The carmaker had been found guilty of participating in a cartel in 2015, but the decision of the competition authority was only made final in 2021, following a ruling by the national Supreme Court.
