CoStar-CREXi appeal ruling undermines US refusal-to-deal protections, tech group says

( August 18, 2025, 23:40 GMT | Official Statement) -- MLex Summary: CoStar's antitrust claims against the Commercial Real Estate Exchange were revived by a federal appeals court ruling analysis that "permits any plaintiff to plead around settled refusal-to-deal protections," tech lobby group Chamber of Progress said in a proposed amicus brief filed with the US Court of Appeals for the Ninth Circuit. By accepting CREXi's "rebranding" of restrictions governing access to CoStar's proprietary systems as exclusive dealing, the Ninth Circuit "transforms refusal-to-deal doctrine from a substantive rule into a pleading obstacle that artful labeling can easily avoid," the brief said.See attached file....
