Wabtec defeats Progress Rail's US Clayton Act, monopolization claims

( June 12, 2025, 19:58 GMT | Official Statement) -- MLex Summary: A Delaware federal judge granted Westinghouse Air Brake Technologies’ (Wabtec's) motion to dismiss Progress Rail Services' claim that Wabtec's acquisition of GE Transportation substantially lessened competition in violation of Section 7 of the Clayton Act. US District Judge Colm Connolly said he agreed with Wabtec that the claim "should be dismissed because the only anticompetitive effect of Wabtec's acquisition of GE Transportation identified in the Complaint — i.e., that Wabtec's post-acquisition control over the production of PTC systems and cab electronics and finished locomotives has harmed competition — is alleged only in conclusory terms." The judge also threw out Progress Rail's monopolization and attempted monopolization claim against Wabtec.See court's order. ...
