US DOJ files emergency motion opposing Google request over key deposition

( June 9, 2025, 16:32 GMT | Official Statement) -- MLex Summary: The US Department of Justice and states told a federal judge that Google's request for an order limiting the agency's deposition of Arnaud Créput — "the chief executive officer of one of the few publisher ad server providers that remains" after Google's dominance in the same market — is an attempt to silence testimony that has been relied upon by the court before for its liability decision. Google has requested that in order for the DOJ's deposition of Créput to be admissible, Google must take 3.5 of the 4 available hours Créput has volunteered to be deposed, a "false choice" forced by Google and the fact that Créput is a foreign national otherwise outside of subpoena jurisdiction, said the DOJ's memo in opposition to Google's emergency motion filed to the Eastern District of Virginia. "The Court should reject the false choice Google has posed: either Plaintiffs be denied time to examine Mr. Créput or his testimony be excluded before it is even offered," it said.See attached document....
