California Public Utilities Commission moves to dismiss US energy price-fixing claims

( June 6, 2025, 21:16 GMT | Official Statement) -- MLex Summary: The California Public Utilities Commission moved today to dismiss Pacific Gas and Electric consumer Michael Boyd's amended US price-fixing complaint, telling a federal judge that "little differs between the original complaint and the FAC, except that Mr. Boyd has now completely withdrawn his allegations against Governor Newsom, [added] Matthew Baker as a Commission Defendant, and he has restyled his third cause of action for 'unjust enrichment' as a state-jurisidictional claim under the Public Utility Regulatory Policies Act." Like the original complaint, Boyd's claims still fail to allege a conspiracy with enough detail to be actionable, the Commission defendants are still immune from federal Sherman Act claims, and without federal-question jurisdiction, Boyd's two state-based claims must be remanded for proceedings in state court, the motion to dismiss filed to the Northern District of California said.See attached document....
