Beemster cheese sellers need broad accord to claim Belgian exclusivity: EU court

( May 8, 2025, 09:58 GMT | Official Statement) -- MLex Summary: Whether cheese distributor Beevers Kaas can claim exclusivity to sell Beemster cheese in Belgium depends on whether it and its supplier Cono can show Cono's other sellers had agreed to that exclusivity, the EU's top court has said. It was not enough to simply point to the fact that others did not sell into Belgium. Today's guidance follows a referral by an Antwerp appeal court, looking into a dispute between supermarket Ahold Delhaize and Beevers Kaas, which has sold Beemster cheese in Belgium since the 1990s, over the application of EU competition law to distribution deals and cross-border sales.  The judgment is attached.
