( April 25, 2025, 21:45 GMT | Official Statement) -- MLex Summary: California Governor Gavin Newsom has moved to dismiss a Pacific Gas & Electric consumer's US price-fixing claims over an alleged conspiracy between energy companies, Newsom and California state officials to raise the cost of energy for solar energy providers. The plaintiff's claims against the governor should be dismissed as there is no Sherman Act or Cartwright Act liability for actions that a state takes in its sovereign capacity, the claims against the governor are barred by Eleventh Amendment immunity, and the complaint fails to allege basic facts pleading that the governor entered into any supposed conspiracy or that he was enriched at the plaintiff's expense, the motion to dismiss filed to the Northern District of California said.See attached document:...
