Swedish Match moves to dismiss US antitrust claims over smokeless tobacco

It said that on top of failing to adequately plead that the litigation was a “sham,” plaintiff does not plausibly allege that any of the challenged litigation harmed the competitive process. “While Plaintiff alleges that Dryft Sciences sold the rights to its product to British American Tobacco at a price Dryft Sciences did not like, the complaint makes no allegations that BAT no longer competes in the marketplace with those assets.
